Procedure for using the locking-plate-type parking space

*The procedure for using parking spaces may differ depending on the parking lot, i.e., in the case of the lockless-type parking, etc.

How to park

Before driving the vehicle into the parking space, make sure that the locking plate is down and that there are no safety-related issues.

Slowly drive over the locking plate and park the vehicle.

How to exit

Enter the parking space number in the fee settlement machine, which will show the parking fee owed.
*The user may need to press the 'enter (確認)' button, etc., after entering the parking space number, depending on the type of machine being used.

Procedure for using the gate-type parking space

How to park

Stop the vehicle in front of the ticket machine. Then, press the 'ticket issue (発券)' button.

When the ticket is taken, the boom gate will open.
*Please keep the ticket in a safe place, as it will be needed to exit the parking lot.

Park the vehicle in any open parking space.
*Be sure not to park the vehicle in a space that is reserved for monthly rental (月極) or exclusive use (専用).

How to exit

Stop the vehicle in front of the fee settlement machine. Then, insert the ticket into the machine.

Pay the parking fee being displayed on the machine.
*Credit card payment option is available only at certain parking lots.

After the parking fee has been paid, the boom gate will open. Then, the user may drive out of the parking lot.
*Please do not back up the vehicle after passing the gate, as doing so could break the boom that comes down after the vehicle once passes it.

Terms of use of parking spaces

CHAPTER 1 GENERAL PROVISIONS

ARTICLE 1 FORMATION OF CONTRACT

  • Each parking lot user (hereinafter referred to as the “User”) must agree to these terms before its actual use of the parking lot. These terms shall apply to the User from the time it enters into the parking facility until the time it exits the parking facility.

ARTICLE 2 PURPOSE OF USE OF THE PARKING LOT

  • Starts Amenity Corporation (hereinafter referred to as the “Administrator”) shall offer a space on the parking lot to the User for a fee pursuant to these terms.

ARTICLE 3 PARKING FEE

  • Each User of the parking lot shall be obliged to pay its parking fee for the period of time that it uses the parking lot, in the amount and pursuant to the fee schedule as indicated at the parking lot.
  • The period of time that the User is deemed to have used the parking lot is defined as the sensor-detected time duration that begins when the vehicle is first parked in a parking space and ends when the vehicle is driven out of the parking space.
  • The User must pay its parking fee using the fee settlement or payment machine, etc., that is installed at the parking lot. The User must settle its payment by following the specified fee settlement procedure.

ARTICLE 4 TIME PERIOD ALLOWED FOR TIME-CHARGE USE

  • The User shall be allowed to use the parking lot for a maximum of 48 consecutive hours per use (unless the User has a parking pass).
    However, the above restriction does not apply, if the User has obtained the Administrator's prior permission to park its vehicle for a longer period of time due to an unavoidable reason, or if a different time restriction is indicated at the parking lot.

ARTICLE 5 TYPES OF VEHICLES THAT ARE NOT ALLOWED TO USE THE PARKING LOT

The following types of vehicles are not allowed to use the parking lot. However, if this particular parking lot has a special designation as to what types of vehicles are allowed contrary to the following restrictions, such special designation must be followed instead.

  • Vehicle restrictions by size
  1. Total vehicle length: any vehicle longer than 5.0m is prohibited. Total vehicle width: any vehicle that is wider than 1.9m is prohibited. Maximum vehicle height: any vehicle that is higher than 2.1m is prohibited. Maximum load weight: any vehicle with a maximum load weight in excess of 2.0t is prohibited.Minimum ground clearance: any vehicle with a minimum ground clearance of 15cm or less is prohibited. (However, if a different restriction on the maximum vehicle height is indicated at the parking lot, it must be followed instead).
  • Vehicle restrictions based on statutory violation, etc.
  1. Any unregistered vehicle, vehicle with expired automobile inspection, and vehicle that is otherwise not legally allowed to be operated on public roads.
  2. Any vehicle that is difficult to be identified by automated registration number recognition equipment, i.e., a vehicle with a covered or removed number plate, etc.
  3. Any vehicle for which the vehicle registration number has been changed but the registration amendment procedure has not yet been officially completed.
  4. Any vehicle that is otherwise difficult to identify, i.e., a vehicle that is only temporarily registered, etc.
  • Vehicle restrictions from the perspective of preventing damage to other vehicles
  1. Any vehicle with an attached item that could come in contact and possibly damage the parking facility, equipment, or another vehicle.
  2. Any special large vehicle or construction work vehicle, etc., that could possibly damage the parking facility or equipment.
  3. Any vehicle carrying a dangerous item, hazardous contaminant, or other item that could cause a safety or health hazard, offensive odor, or liquid leakage.
  4. Any vehicle with carrying gear being attached that could come in contact with another vehicle, or from which a load might fall off.
  • Applicability of any of the aforementioned restrictions shall be determined by also considering any equipment being attached to the vehicle, load being carried by the vehicle, etc.
  • Restrictions on motorcycles, tricycles, etc.
    Any motorcycles, motorized bicycles, bicycles, special small vehicles, side cars, tricycles, buggies, trikes, and the like shall not be allowed.
    However, if a sign says that any of these vehicles may be parked, parking shall be allowed, provided that the User complies with the rules being posted there.

ARTICLE 6 VEHICLE OPERATION IN THE PARKING LOT

The User must comply with the following rules when operating its vehicle inside the parking lot.

  • The User must operate its vehicle at a speed of 8km/h or below, while ensuring the safety of any pedestrians, etc., that may be present in the parking lot.
  • No passing is allowed.
  • The User must yield to any vehicle that is pulling out of a parking space.
  • If any special instruction is provided by the parking lot staff, the User must obey such instruction.

ARTICLE 7 MATTERS THAT ARE COMPULSORY OR PROHIBITED

  • The User must abide by the following rules when using the parking lot.
  1. The User must check what its parking space number is, and pay the parking fee before driving the vehicle out of the parking space.
  2. If the User is driving its vehicle from the parking space and it has to pay no fee due to the short length of the parking time, or a reduced fee due to a discount service, etc., the User must still settle its account using the fee settlement machine without exception.
  3. The User must take with it any valuable and other belongings of significance, instead of leaving them in the vehicle.
  4. The User must shut off the engine at all times when the vehicle is parked. When the User intends to leave the vehicle, it must close all windows and lock all doors and also the trunk.
  5. The User must park its vehicle in a specified parking space and must not park it in any other place.
  6. The User must not leave any infant alone inside the parked vehicle.
  7. The User must not leave any animal behind in the parked vehicle.
  8. In addition to the aforementioned restrictions, the User must obey any other instructions that the Administrator or the parking lot staff may provide.
  9. Smoking and use of fire are strictly prohibited in the parking lot.
  10. The User must not bring any explosive or inflammable item into the parking lot.
  11. The User must not engage in any act that could be a nuisance to the people nearby, such as use of a car stereo with the volume turned up, opening and closing car doors in a rough manner, speaking in loud voice at night, etc.
  12. The User must pay due attention to keeping the parking lot clean and must not litter it with glass bottles, cans, waste paper or cloth, cigarette butts, magazines, bulk trash, etc.
  13. The User must not engage in any other acts besides parking its vehicle in the parking lot (which include sales activities, advertising, canvassing for donations, collecting signatures, etc.).
  14. If the User has any unhygienic item being carried in or attached to its vehicle, or if there is a risk that any liquid could be discharged or spilled from its vehicle, the User shall be prohibited from bringing the vehicle into the parking lot.
  15. The User must not engage in any act that could be a nuisance to others in the parking lot, such as drinking alcoholic beverages, lodging, gambling, car washing, etc.

CHAPTER 2 DISCLAIMERS AND THE USER'S RESPONSIBILITY TO COMPENSATE FOR DAMAGE

ARTICLE 8 DISCLAIMERS

In principle, the Administrator shall not be held responsible for a theft or loss of, or damage to, any vehicle or any item being carried by a vehicle in any of the cases as specified in (1) through (12) below.

  • In principle, the Administrator shall not be held responsible for any damage suffered by a User that is caused by an act of another User of the parking lot or another person, or by another vehicle, any item attached thereto, or any item being carried thereon that exists in the parking lot:
  1. refund request, etc., by the User after the User had failed to check or properly identify its parking space number and incorrectly settled the parking fee;
  2. damage suffered by the User in the form of its vehicle, etc., getting damaged by the locking equipment (i.e., the flap plate or the lift) as a result of the User not properly checking to see if it was fully lowered to the ground, when entering into or exiting from the parking space;
  3. damage suffered by the User in the form of a theft of its vehicle or any item being carried on, attached to, or left inside the vehicle (i.e., theft of its vehicle or any part thereof);
  4. damage suffered by the User in the form of damage being caused to any modified body part that is attached to its vehicle, if any, after the User having driven such vehicle into the parking lot and the part coming into contact with any parking equipment;
  5. any other type of damage suffered as a result of the User parking its vehicle in violation of ARTICLE 5 hereof;
  6. damage suffered as a result of the User operating its vehicle in violation of ARTICLE 6 hereof;
  7. any other type of damage suffered due to the User's own negligence;
  8. damage suffered as a result of a natural disaster such as a typhoon, storm, flood, earthquake, fire, or lightning strike, or any other force majeure event;
  9. damage suffered by the User in the form of time spent waiting for any unauthorized vehicle or another vehicle, etc., that prevented the User from entering into or exiting from a parking space; lost opportunity; or any other type of damage;
  10. damage suffered by the User as a result of any trouble that the User became involved in with another parking lot User or a third party;
  11. damage suffered by the User as a result of any action taken pursuant to ARTICLE 11 [SUSPENSION OF PARKING LOT OPERATION, ETC.] or ARTICLE 12 [CHANGING OF PARKING LOCATION] hereof; and
  12. damage suffered by the User as a result of it being unable to drive its vehicle out of the parking space due to a cause that is not attributable to the Administrator or any other type of damage.

ARTICLE 9 THE USER'S RESPONSIBILITY TO COMPENSATE FOR DAMAGE

  • If the Administrator should suffer any damage as a result of the User having used the parking lot in a manner that does not comply with these terms, any rules that are indicated at the parking lot, or the User causing damage to any parking facility or equipment through an intentional act or gross negligence, the User shall be responsible for compensating the Administrator for such damage (including the lost operating profit that is caused as a result of the Administrator being required to suspend the operation of the parking lot, in whole or in part, if the situation calls for such measure).
  • If the User is found to engage in any unlawful act or in breach of the proper procedure for using the parking lot or the terms of use of the parking lot, the Administrator shall be entitled to take any action that is necessary for remedying the situation, by locking up the vehicle using chains, moving the vehicle to another location (using a tow truck), etc., in which case, the User (the owner of the vehicle and also any passenger riding in the same vehicle) must pay the following as damages to the Administrator:
    (1) a regular parking fee; (2) actual damage suffered and cost incurred (i.e., the cost of locking up the vehicle using chains, removal of the vehicle by tow truck, investigation of the vehicle, inspection of any machine and equipment being involved, etc.); and (3) a fine of \50,000.
  • If the User (the owner of the vehicle and also any passenger riding in the same vehicle) has caused any damage to the parking lot facility, another vehicle being parked, or another User of the parking lot, etc., the User must immediately compensate for the damage by making a proper amount of payment to the party suffering the damage. If the User should fail to report any such incident or make the payment being owed, the case will be reported to the local police.

ARTICLE 10 UNAUTHORIZED PARKING

  • If the User is found to have entered into or exited from a parking space or otherwise exited the parking lot through unauthorized means without paying the parking fee, the Administrator may request the User to pay the parking fee being owed along with the damages, etc., as specified in ARTICLE 9 hereof, etc. For this purpose, the following types of vehicle parking shall be deemed unauthorized:
  1. parking of a vehicle over or outside the lines indicating the designated parking space;
  2. parking of a vehicle over multiple parking spaces;
  3. unpermitted entry or parking of a vehicle into a parking space that has been closed off by the Administrator using safety cones, tape, rope, etc.;
  4. parking of a vehicle that is prohibited from using the parking lot pursuant to ARTICLE 5 hereof; and
  5. any other act of exiting the parking space or parking lot without settling the parking fee being owed.

ARTICLE 11 SUSPENSION OF PARKING LOT OPERATION, ETC.

  • If any of the following circumstances should arise, the Administrator shall be allowed to suspend the operation of the parking lot, in whole or in part, isolate the parking lot, close off any vehicle path in the parking lot, or evacuate any vehicle (hereinafter collectively referred to as the "Suspension of Parking Lot Operation, etc."):
  1. if a natural disaster, fire, damage to an explosive facility or equipment, or any comparable accident has occurred or could possibly occur;
  2. if it is deemed necessary to perform any work, cleaning, or sterilization in the parking lot; or
  3. if it is otherwise deemed inappropriate to continuously operate the parking lot, etc., due to safety or security reasons.

ARTICLE 12 CHANGING OF PARKING LOCATION

  1. If it is necessary to do so to properly administer the parking lot operation, the Administrator shall be allowed to close any of the entry or exit points or parking spaces.
  2. If any vehicle is found to have been parked in the parking lot for more than 48 hours, the Administrator may request the User (including the owner of the vehicle) to move the vehicle from the parking lot, with which the User must immediately comply.
    In such case, the Administrator may lock up the vehicle using chains, move the vehicle to a different location (by tow truck), or take any other action as needed, in order to ensure that the parking lot remains available and safe for normal use.

ARTICLE 13 ACTION AGAINST ACCIDENTS, ETC.

  • If any accident has occurred or could possibly occur, the Administrator may move any concerned vehicle to a different location and take any other action as needed.

ARTICLE 14 DENIAL OF ENTRY INTO THE PARKING LOT

  • If the parking lot is full, the Administrator may deny any additional vehicle from entering into the parking lot. In addition, if any User or vehicle is found to be in breach of any of the rules as set forth in ARTICLE 6 and ARTICLE 7 or otherwise engaged in any prohibited act, etc., the Administrator may deny the User from using the parking lot or force the vehicle out of the parking lot.

CHAPTER 3 ACTION AGAINST VEHICLES THAT ARE NOT REMOVED FROM THE PARKING LOT DESPITE REQUEST

ARTICLE 15 ABANDONED VEHICLES

  1. If any time-charge User of the parking lot is found to have been parking its vehicle for over seven consecutive days without notifying the Administrator in advance, the Administrator may request the User to remove the vehicle from the parking lot by a certain date to be specified by the Administrator, either by directly providing a notification to the User or posting such notification at the parking lot.
  2. In the event as described in the preceding paragraph, and if the User has refused to remove its vehicle despite the Administrator's request or is unable to do so, or if the User of the vehicle at issue cannot be properly identified through no fault of the Administrator, the Administrator may request the owner, etc., of the vehicle (i.e., the owner and the User of the vehicle as stated in the automobile inspection certificate; the same shall apply hereafter) to remove the vehicle from the parking lot by a certain date to be specified by the Administrator, either by directly providing a notification to the vehicle owner, etc., or posting such notification at the parking lot.
    In such case, the User shall be deemed to have waived all the rights that it would otherwise be entitled to when showing up and taking possession of the vehicle at the parking lot, and must agree not to file a request for the Administrator to deliver the vehicle to the User or any other type of motion or objection against the Administrator.
  3. If the Administrator intends to make the request in writing as specified in either of the two preceding paragraphs, and if the requested vehicle owner, etc., has failed to show up and take possession of its vehicle as requested by the date as specified by the Administrator, the Administrator shall be allowed to additionally state that the vehicle owner, etc., is deemed to have refused to comply with the request.
  4. If any damage is caused to the vehicle after the specified date as set forth in (1) above, the Administrator shall not be held responsible for compensating for such damage, unless the damage is caused by the Administrator's intentional act or gross negligence.

ARTICLE 16 INVESTIGATION OF VEHICLES

  • To an extent necessary to properly identify any User, vehicle owner, etc., pursuant to ARTICLE 15 (1) hereof, the Administrator shall be allowed to unlock the vehicle at issue and investigate it (including the inside of the vehicle).

ARTICLE 17 RELOCATION OF VEHICLES

  • If any circumstance arises as specified in ARTICLE 15 (1) hereof that could cause an administrative issue, the Administrator shall be allowed to move the vehicle to another location while so notifying the User, vehicle owner, etc., or posting such notification at the parking lot.

ARTICLE 18 DISPOSAL OF VEHICLES

  1. If any User, vehicle owner, etc., has refused or is unable to show up and take possession of its vehicle and remove it from the parking lot as requested by the Administrator, or if the User, owner, etc., of any vehicle cannot be properly identified through no negligence of the Administrator, and if the User, vehicle owner, etc., fails to show up and take possession of its vehicle by the notified deadline, as specified by the Administrator after being notified by the Administrator or the notification has been posted at the parking lot, within two weeks of the initial request date, the Administrator shall be allowed to sell, discard, or otherwise dispose of the vehicle, in the presence of a fair third party, after providing a prior notification to the User or posting such prior notification at the parking lot. In such case, if the current market value of the vehicle is apparently less than the cost of the vehicle sale (including the cost of storing the vehicle after the request has been issued by the Administrator), the Administrator shall be allowed to sell, discard, or otherwise dispose of the vehicle immediately after the requested deadline passes, in the presence of a fair third party, after providing a prior notification to the User or posting such prior notification at the parking lot.
  2. If any vehicle has been disposed of pursuant to the procedure as set forth in (1) above, the Administrator shall deduct the parking fee being owned, the cost of vehicle storage, relocation, and disposal from the proceeds, if any, and request the User to pay the balance if the balance is negative, or refund the balance to the User if the balance is positive.

CHAPTER 4 MISCELLANEOUS PROVISIONS

ARTICLE 19 OBTAINMENT OF PERSONAL INFORMATION

  • All personal information that has been provided by the Users for the purpose of using the parking lot shall be properly managed pursuant to the applicable laws, etc.

ARTICLE 20 OTHER IMPORTANT MATTERS

  1. The Administrator shall be allowed to attach documents such as warnings to any vehicles being parked at the parking lot.
  2. Each User must agree that images of the parking lot and the surrounding areas may be captured by the Administrator using video, cameras, etc.; the Administrator may use such images to identify any unauthorized parking cases at its discretion; and the Administrator may submit any such images to government agencies for crime prevention, investigation, and other purposes.
  3. If there is a sign posted at the parking lot stating that there is a 'number plate monitoring camera system' being set up, no vehicle-locking equipment (i.e., flap plate, lift, etc.) is installed, so that the Users can park their vehicles with better ease. Therefore, if any User is found to have exited the parking lot or moved its vehicle from one parking space to another without properly settling the parking fee being owed, etc., it will be held responsible under the applicable civil, criminal, and other laws to compensate for any damage caused and also face any penalty that may apply.
  4. The parking ticket that is issued at the gate-type parking lot when entering will be required when exiting the parking lot.
    If a User that has lost its ticket wants to exit the parking lot, it may do so by pressing the 'ticket lost (券紛失)' button on the fee settlement machine and paying the lost ticket charge.
  5. Aside from the aforementioned terms and conditions, each User must fully comply with the instructions that are posted by the Administrator.
